Critical Skills Visa to PR: The 5-Year Route

The Critical Skills Visa offer a legal pathway for highly skilled foreign nationals to obtain Permanent Residency (PR) in South Africa. If a foreign national possesses the required skills or qualifications as set out by the Critical Skills List published by the Department of Home Affairs (DHA), they may be eligible to apply for permanent residence under Section 27(b) of the Immigration Act.

See here our step-by-step overview of the five-year route to obtaining permanent residency through a Critical Skills Visa:

Step 1: Obtain a Critical Skills Visa

In order to qualify for this visa, the applicant’s profession must be listed on the most recent Critical Skills List. This list highlights occupations facing shortages in sectors such as education, medicine, engineering, and finance.

Applicants must hold a valid qualification that aligns with the identified critical skill. All foreign qualifications must first be evaluated against the South African National Qualifications Framework (NQF) by the South African Qualifications Authority (SAQA). Additionally, the applicant must be registered or licenced with the relevant professional council or board.

Lastly, the applicant will require a formal job offer from a South African employer to support the application.

Step 2: Five Years’ Work Experience

To qualify for permanent residency in South Africa, applicants must generally provide proof of at least five years’ post-qualification work experience that’s relevant to the critical skill. The obtained experience needs to be verifiable, but it does not need to have been gained exclusively in South Africa. Work experience that’s gained abroad will also count, provided that the applicant holds a valid Critical Skills Visa when applying for permanent residency.

Step 3: Apply for Permanent Residency

Your application will be reviewed by the DHA, with processing times for Critical Skills Permanent Residence applications typically ranging from 12 – 18 months, although some are processed and finalised in a shorter timeframe.

Once you’ve received your PR certificate, you will no longer be required to maintain a temporary residence visa, and you may live and work in South Africa indefinitely. However, you must not remain outside of South Africa for more than three consecutive years, as this may cause your permanent residency to lapse.
