This Act was put in place to regulate the entry, residence, and departure of foreign nationals with emphasis on national security and economic interests. Normally, the law requires foreign nationals to apply for a change of visa status from outside the country of South Africa at a South African diplomatic mission abroad. Who Can Change Visa Status from Within South Africa?
- Spouses and minor children: of a South African citizen or permanent resident;
- Accompanying spouses and dependent children: of a work or business visa holder who wishes to hold a work or study visa; and
- Medical treatment: a tourist who needs medical treatment in South Africa and is unable to leave;
A change of conditions or status while in the Republic of South Africa is prohibited if you hold a visitor’s visa or wish to change from a medical treatment visa. The only exceptions are those that are listed above.
Suppose you are married to a South African citizen or permanent resident, or are their dependent child, you can apply for a “relative visa” or a spousal visa from inside the country. It is important to note that you must have a valid marriage certificate, proof of relationship, and/ or other additional supporting documents.

What if I am on a Tourist or Visitor’s Visa?
In short, the answer is no, the Immigration Act does not permit any person to change from a tourist/visitor visa to any other visa category from within South Africa. As such, a new application is required to be filed within your home country or country of residence.
It is usually required for such an individual to leave the Republic in order to change their visa or immigration status. The reasoning behind this is as follows:

- Administrative control
