26 Aug What To Do If Your Visa Is Denied: SA Appeal Process
Every year, there is an increasing number of applicants in South Africa who encounter visa rejections. This process generally leads to confusion and a significant amount of stress, especially when the reasons for the denial are complex or simply unclear.
You might be wondering what you should do next. Understanding the various factors that contribute to visa rejections and how these reasons differ is an important start. This understanding is crucial for anyone considering an appeal.
The Most Common Reasons for Visa Rejections
If your South African Visa application was rejected, what now? There are several reasons for rejection that often arise, as cited by the Department of Home Affairs (DHA). Documentation is one of the most frequent reasons for refusal of visas and pertains to the absence of required proof or documentation, i.e., a certified copy of your ID, police clearances, or proof of relationship.
The remaining reasons are that applicants might be ineligible or not satisfy the exact statutory requirements for their desired visa class, or applicant data variations, which are normally differences between third-party records and application forms presented, e.g., conflicting addresses or work history. Old financial data is also a common technical refusal, which occurs when bank statements or fund records are more than five days old when presented.
Another choice you may be considering is whether or not to reapply for your visa or appeal against refusal. This will depend on the nature of the visa, the reason that the application was refused, and whether you still hold a valid visa. Whereas appealing is preferable if your first application was otherwise sound but failed due to something being omitted or an error on the side of Home Affairs, reapplying is advised when the fundamental requirements for eligibility were not fulfilled, or documents need to be resubmitted. Technical refusals could still be appealed in the event of minor errors that are correctable through clarified or revised documentation.
If it is a Spousal Visa or Volunteer Visa, you can appeal with emphasis on relationship evidence and clarify the sponsoring body and the role, whereas for a General Work Visa/Business Visa, you should likely reapply since you may require the proper employer documentation. You can also consider how to extend your South African tourist visa.

The Visa Appeal Process
One of the assumptions made is that South African visa appeals can be submitted directly to the Department of Home Affairs (DHA), but this is not true. All visa appeals have to be submitted through VFS Global, as that is where the initial application was done, and they are the outsourced service provider of the government of South Africa for receiving visa applications. One thing that is worth mentioning here is the fact that as soon as your visa is rejected, you have ten working days to lodge an appeal via the VFS Global and physically attend the offices for submission.
This appeal file should include a cover letter presenting your case, accompanied by an addendum or corrected documentation. The application is then forwarded to the DHA for consideration, and the ruling is pursued by the Director-General of the Department of Home Affairs, who has legislative powers to set aside or uphold visa rulings.
It can be frustrating to deal with a visa refusal, but it’s not necessarily the end. You can boost your chances and improve your application by discovering the reasons for refusal, determining whether to reapply or appeal, and getting through the right VFS Global procedure within the ten-day timeframe.
