13 Nov Restoring South African Citizenship from Abroad
Need assistance restoring your South African citizenship from abroad? If you need or want to restore your South African citizenship, you should be aware of the recent changes. Following a landmark Constitutional Court ruling in May of 2025, you may have never lost your South African citizenship.
Anyone who was deemed to have lost their citizenship by not filing a retention application prior to acquiring another citizenship is now deemed never to have lost it. Restoration of your South African citizenship is automatic. There is no need for a resumption application.
However, persons who lost citizenship before 1995 under earlier laws, or who lost it for other reasons such as voluntary renunciation or security violations, are not covered by this automatic restoration and must apply for resumption of their South African citizenship.
If you formally renounced your South African citizenship, and must apply for resumption through a formal application to the Department of Home Affairs. If you need guidance, here is how immigration attorneys help restore your citizenship.

How to Restore Your South African Citizenship
1. Determine whether you are eligible
Be sure to confirm whether your loss of citizenship falls under section 6(1)(a) of the Citizenship Act or if it requires a formal application, such as if you lost your citizenship due to a renunciation application.
2. Submit your application
Applications for resumption must be submitted in person at a department of Home Affairs in South Africa after having resided in South Africa for twelve (12) months or longer.
If you lost your citizenship due to section 6(1) of the South African Citizenship Act, no formal application is required – although it may be in your best interest to make an application for ‘determination of citizenship’ through your South African embassy abroad, or through the Department of Home Affairs. In the future, using SA’s new portal to restore citizenship online will be a welcomed option.
3. Await processing and receive a decision
The processing time for resumption or a determination of citizenship application can range between 3 to 12 months, with delays common due to administrative backlogs. If your application for resumption is approved, you will receive a certificate or letter confirming restoration of citizenship. If you apply for a determination of citizenship application, you will be notified if you are still a South African citizen by a formal letter from the Department of Home Affairs.
The constitutional court ruling has made it easier for many South Africans abroad to reclaim their citizenship, particularly those who lost it under the now-invalidated Section 6(1)(a) of the Citizenship Act.
