Travelling abroad always brings happiness and excitement as you are experiencing someplace new; however, the consequences of overstaying your visa can quickly turn your happy trip into a legal nightmare.
Have you overstayed your visa?
Overstaying your visa means that you have remained in the country beyond the period of time that your visa or authorised stay allows. Thus, you entered the country legally with a valid visa, but you didn’t leave before your visa expired or before the authorised duration of your stay.
Travel regulation changes were made in the year 2014; before then, visitors who overstayed merely had to pay a fine upon departure, but this is no longer the case. If you’ve overstayed your visa duration, when exiting South Africa, an immigration officer will issue a declaration of undesirability, detailing your personal information, overstay duration, undesirable status (lasting 1 to 5 years), and information on appealing this status. Upon departure, any visitor who overstayed their visa will become an undesirable person and be banned from returning to the country.

You can appeal the undesirability notice
Once you receive the undesirability notice, you have ten working days to submit an electronic appeal to the Immigration Department. Your appeal should outline the reasons for the overstay, such as pending applications, medical reasons, or airline-induced changes. Supporting documents, including your passport identity page, undesirability letter, and documents explaining the overstay, must accompany the appeal. You can extend your South African Tourist Visa to avoid being declared undesirable.
Resolve the Overstay
While it may sound terrifying, being declared an undesirable person can be remedied. If you have overstayed your visa for a genuine or unforeseen issue (e.g., medical reasons, a family emergency, etc.), you may qualify for an upliftment of the undesirable status. The ideal outcome is a response within ten days; delays are common due to a backlog in the Department. We emphasise the importance of persistent follow-ups.
